Mrigtrishna Bar

Developer/Builder Info

Brief of Title regarding Gajner Estate
At the time of the merger of Bikaner State inventory of the Private Properties of His Highness The MAHARAJA of Bikaner was settled and confirmed to the government of India, in terms of Aticle XII of the Covenant. This inventory inter alia included the property known as Gajner Estate, at item no 3 under heading "B" (Immovable Properties) as described and as per plan attached therewith. Whereas as provided in Article XII of the Covenant, the Maharaja was entitled to full ownership, use and enjoyment of all such private properties. Whereas on the death of Maharaja Sadul Singhji, his son Maharaja Karni Singhji succeeded him as absolute owner of all his properties. i.e. his entire estate and acquired in his possession, management and control all properties comprised in the estate include Gajner property/Gajner Estate. Whereas he was also recognised as the ex-ruler of Bikaner State by the President of India. Whereas Maharaja Dr Karni Singhji in exercise of his rights as ex-ruler and absolute owner of the said Gajner Property/Gajner Estate, started running, managing and operating Gajner Palace Hotel as Proprietor, in his personal capacity, in the said property comprising of buildings, lake, sports complex and outer land. Whereas Maharaja Dr Karni Singhji during his life time executed his last will and Testament dated 26" June 1986. Hon'ble Bombay High Court has already granted probate of the said Will of Maharaja Dr. Karni Singhji, in favour of the Executors on 4h April, 1990. Whereas Clause 66 of the said probated Will provided that Rajmata Sushila Kumariji and Princess Rajyashree Kumariji shall hold Gajner property comprising of buildings, lake, sports complex and outer land (i.e. entire Gajner Estate), upon trust. He also duly authorised his wife Rajmata Sushila Kumariji and daughter Rajyashree Kumariji or the survivor of them to appoint themselves or any other person or persons as Trustee or Trustees of the said Gajner Property Trust. Whereas pursuant there to Rajmata Sushila Kumariji and Princess Rajyashree Kumariji appointed themselves as trustees of the said Gajner Property Trust. Whereas upon the death of Maharaja Dr. Karni Singhji, Gajner Property/Gajner Estate was duly conveyed to the Trust and thus came to be vested in the Gajner Property Trust created under the Will and Gajner Palace Hotel is a running business run in the Gajner Property/ Gajner Estate under the control, supervision and management of this family Trust. Whereas Princess Rajyashree Kumariji was being a British National Citizen and according to the provision no 80 of the said Probated Will, she was acted against Will, so she has lost all the benefits bequeathed by the said Probated Will, that is why she could not act as trustee and/or even otherwise she had ceased to be a Trustee on account of her being permanently settled abroad and her continuous absence from India for a period exceeding six months and because of her actions contrary to the said Probated Will.

2 Whereas Rajmata Sushila Kumariji, executor and the only other trustee under the probated Will is fully competent and she appointed Maharani Padma Kumari, Princess Madhulika Kumari, Princess Mahima Kumari and Shri Mohan Singh as Trustees of the Trust and accordingly appointed them as Trustees of Gajner Property Trust. Whereas Rajmata Sushila Kumariji is vested with overriding powers under clause 10 of the said Probated Will, pertaining to the interpretation, working and implantation of any clause of the Will or otherwise and thus making it clear that her wishes have to prevail in case of any difference on any matter covered under the Will and hence she was fully competent to make the said appointment of the trustees of Gajner Property trust.
Whereas Princess Rajyashree Kumari had filed Civil Original Suit No 156/1994 (Princess Rajyashree Kumari v/s Rajmata and ors) for declaration and permanent injunction, inter alia praying that the appointment of said Trustees by Rajmata Sushila Kumariji be held to be without authority and she and said Trustees be restrained from acting as trustees of the Gajner Property Trust. Princess Rajyashree Kumari had also applied for temporary injunction in the suit (T.I. Appl. No. 112/1994) which was opposed by Rajmata Sushila Kumariji. The learned Trial Court in that matter so far rejected the abovementioned Civil Original Suit stating that the Rajmata Sushila Kumariji is entitled to appoint any trustee/trustees and to transfer by any mode of transfer. Whereas Rajmata Sushila Kumariji along with the consent of said trustees executed a lease deed in favour of Rajput Hotels & Resorts Pvt. Ltd. dated for the term not exceeding for 21 years from the date of execution of said lease deed. The said lease period has been over and the said lease deed has not been extended according the lease deed or any manner, hence the said lease deed has been determined legally in accordance of the terms and conditions of it. Whereas at present the said lease deed is to be surrendered by the said Lessee RHR Pvt Ltd and the peaceful vacant possession of the Gajner Property/ Gajner Estate is to be obtained from the said lessee RHR Pvt Ltd and the said Lessee RHR Pvt Ltd is agreed to surrender the lease deed and agreed to hand over the peaceful vacant possession of the Gajner Property/ Gajner Estate to GPT.
