Agreement For Purchase of Property Between Seller and ghardhudho
This Agreement is entered on ………………Day of………………2024 between the Seller and ghardhudho.com upon the terms and conditions as agreed below:
I, [Seller's Name__________________] (Directors Name in case of a Company), residing at [Seller's Address____________________________________________________________] (Registered Address in case of a Company) hereby enter into this Seller agreement with ghardhudho.com (Service Provider Company) for availing your services in the process of property lease and potential future property purchases.
1. Property Sale : That the Seller has decide to sell a property(As Described in Schedule), and for the purpose appoint ghardhudho.com, as my exclusive Seller's agent for the said property purchase. By virtue of this agreement I understand that ghardhudho.com will represent my interests and assist me in the selling process and I further assure that I will abide by the terms and conditions as set forth with by ghardhudho.com.
2. Declerations with regard to the Property : That the seller understands that all the information regarding the property (as described in the profile) which is intended to be sold is sole responsibility of the seller. The seller also undertakes that said property as enlisted, is under the clear title of the seller and in the possession of the seller and further undertakes that any wrong or misinformation will lead to cancellation of the present agreement and forfeiture of the earnest amount deposited. Further ghardhudho.com will not held liable or responsible for any loss incurred due to such misinformation.
3. Earnest Amount : That the Seller understands that the property searches and negotiations incur certain expenditure as to sort out genuine buyer and seller and thus the seller undertakes to deposit an amount of Rs…………………………………prior to the searches and negotiations with regard to any property with respect to ghardhudho.com.
4. Commission : As a Seller, I further agree to pay ghardhudho.com a commission of 50,000/-(Fifty Thousand Only) if the value of the property values below 1,00,00,000/-(Rupees One Crore) and 2%, (if the value is above One Crore) of the total selling value of any property to be sold by me with the facilitation of ghardhudho.com., wherein ghardhudho.com has played a direct role in identifying or facilitating the transaction.
5. Duration of Agreement : This agreement shall remain in effect for a period of 6 months, starting from the date of signing this agreement, further any property which is facilitated by ghardhudho.com shall not be further negotiated by the buyer directly with the seller, without the prior consent of ghardhudho.com, for a period of one year It may be extended further by mutual consent in writing.
6. Confidentiality : I understand and agree that all information shared with ghardhudho.com during the property search, or selling process shall be treated as confidential and will not be disclosed to any third party without express written consent of either parties..
7.Governing Law : This agreement shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of Lucknow, Uttar Pradesh.
8. Entire Agreement : This Seller Agreement, along with the attached profile, commitment letter, schedule or addendum(if any), constitutes the entire agreement between the parties and supersedes all prior discussions, understandings, or agreements, whether oral or written.
Signing this agreement with the terms and conditions mentioned above acknowledges that both the parties agree with the terms and conditions mentioned here-in above.
